Notice

MemeDome respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

1. Overview

The Digital Millennium Copyright Act (DMCA) provides a process for copyright owners to request the removal of allegedly infringing material from online services. MemeDome complies with the DMCA and will respond to valid DMCA takedown notices by removing or disabling access to the allegedly infringing content.

If you believe your copyright has been infringed on MemeDome, you may submit a DMCA takedown notice. We will review your notice and take appropriate action.

2. Filing a DMCA Takedown Notice

To file a DMCA takedown notice, you must provide the following information in writing:

  • Identification of the copyrighted work: Describe the copyrighted work that you claim has been infringed. If you are the copyright owner, provide sufficient detail to identify the work. If the notice covers multiple works, you may provide a representative list.
  • Identification of the infringing material: Provide the URL(s) or other specific location(s) on MemeDome where the allegedly infringing material is located. You must be specific enough that we can locate the material.
  • Contact information: Include your full name, mailing address, telephone number, and email address.
  • Good faith statement: Include the following statement: "I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  • Statement of accuracy: Include the following statement: "The information in this notice is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the copyright owner."
  • Electronic signature: Your physical or electronic signature.

3. How to Submit Your DMCA Notice

Please note that we must receive your notice by email. Physical mail will not be processed.

4. Our Response Process

Upon receipt of a valid DMCA takedown notice:

  1. We will review the notice to ensure it meets DMCA requirements
  2. If valid, we will remove or disable access to the allegedly infringing content within a reasonable time
  3. We will notify the user who posted the content about the removal
  4. We may terminate repeat infringers' accounts

We will not disclose your personal information to the user unless required by law.

5. Counter-Notification Process

If you believe your content was removed in error, you may file a counter-notification. A counter-notification must include:

  • Identification of the removed content: Identify the specific content that was removed and its location before removal.
  • Statement under penalty of perjury: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
  • Your contact information: Full name, address, phone number, and email address.
  • Consent to jurisdiction: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, and I will accept service of process from the person who provided the original DMCA notification or an agent of such person."
  • Physical or electronic signature.

6. Counter-Notification Submission

After receiving a valid counter-notification, we will:

  1. Forward it to the original complainant
  2. Restore the content within 10-14 business days unless we receive notice that legal action has been filed

7. Repeat Infringer Policy

MemeDome maintains a repeat infringer policy. Users who repeatedly violate copyright laws may have their accounts terminated. We track DMCA notices and take escalating actions:

  • First violation: Content removal and warning
  • Second violation: Temporary account suspension
  • Third violation: Permanent account termination

8. Fair Use Considerations

Please note that not all uses of copyrighted material constitute infringement. Fair use and other exceptions may apply. Before submitting a DMCA notice, consider whether the use might qualify as:

  • Criticism, comment, news reporting, teaching, scholarship, or research
  • Parody, satire, or transformative works
  • Other lawful uses

We encourage copyright owners to evaluate whether a use qualifies as fair use before sending a takedown notice. Misuse of the DMCA process can have legal consequences.
